By accessing and using the website of The Next Device PTY LTD ("TND", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our website or services.

2. Services

TND provides Device as a Service (DaaS), managed IT services, professional services, video conferencing solutions, networking services, cloud infrastructure services, and IT device lifecycle management. Specific service terms are governed by individual service agreements between TND and the client.

3. Pricing & Subscriptions

All pricing displayed on our website is indicative and GST-exclusive unless otherwise stated. Final pricing is confirmed in your service agreement. Subscription terms (36, 48, or 60 months) and pricing may vary based on device configuration, volume, and specific requirements.

4. Intellectual Property

All content on this website, including text, graphics, logos, and software, is the property of The Next Device PTY LTD or its licensors and is protected by Australian and international intellectual property laws.

5. Device Ownership

Under DaaS subscriptions, devices remain the property of TND or our finance partners throughout the subscription term. Clients are granted a licence to use the devices for the agreed term. At end of term, devices must be returned or the subscription renewed.

6. Data Destruction

TND follows NIST 800-88 guidelines for data sanitisation on all returned devices. Certificates of data destruction are provided for every device processed. Clients are responsible for maintaining their own data backups prior to device return.

7. Limitation of Liability

To the maximum extent permitted by Australian law, TND shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or services. Our liability is limited to the fees paid for the specific service in question.

8. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
